TOTAL LOSS APPRAISALS TERMS AND CONDITIONS
By contacting us or doing business with us, you agree to the following:
Privacy Notice
What information do we collect?
We collect information from you when you register on our site, place an order, or fill out a form. When ordering or registering, you may be asked to enter your name, email address, or phone number. You may otherwise visit our site anonymously.
What do we use your information for?
Any information we collect may be used to improve our website and to send you information and updates about your order. The email address you provide during ordering is used only for communications related to your order and your appraisal.
How do we protect your information?
We use a variety of security measures to keep your personal information safe when you place an order or when you enter, submit, or access your information.
Do we share information with outside parties?
We do not sell or trade your personally identifiable information. We may share it with trusted providers who help us operate our website, run our business, or serve you, and only when those providers agree to keep it confidential. We may also disclose information when we believe disclosure is required to comply with the law or to protect our rights, property, or safety, or those of others.
When you ask us to prepare or review an appraisal, you authorize us to use the information and documents you provide, including any letters or reports, in the course of that work. This may include referencing them in communications with your insurance carrier or an attorney if you request that we do so. We will not share your claim materials for that purpose without your request or consent.
Third party links
From time to time we may link to third party products or services. Those sites have their own privacy policies, and we are not responsible for their content or practices. We encourage you to review the policies of any site you visit.
Changes to this policy
If we change this policy, we will post the updated version on this page.
Appraisal Terms and Conditions
Not legal advice
Triple Net Group LLC, Car Appraisals & Claims LLC, and their affiliated companies do not provide legal advice. Nothing on this website or in any report or document we provide is legal advice or an offer to provide legal advice. Our reports reflect our professional opinion, developed through years of experience and training, and are provided on an as is basis.
Independence and discretion
On first party claims, we determine our valuation independently from you and from your insurance company. We may decline service when a request appears fraudulent or erroneous, and we may decline service to anyone who attempts to influence our opinion or valuation.
Desk appraisals and inspections
It is your responsibility to confirm that your carrier will accept a desk appraisal rather than requiring a field inspection. If your carrier requires a physical inspection, contact us before ordering, and do not order a desk appraisal. Nothing in a standard policy appraisal clause requires an appraiser to physically inspect the vehicle. Please read your policy carefully before hiring us.
No affiliation
We are not affiliated with, and have no association with, CCC, JD Power, Mitchell, Audatex, or any insurance carrier or independent adjuster.
Settlement and negotiation are a separate service
Preparing your appraisal and pursuing a settlement are two different services. Your appraisal fee covers the written appraisal report only. It does not include negotiating with your insurer, communicating with adjusters on your behalf, invoking or managing the appraisal clause process, or carrying your claim through to resolution.
If you want help pursuing a settlement after you receive your report, that is a separate engagement with its own scope and its own fee, agreed in writing before any work begins. We do not act as your public adjuster, attorney, or legal representative, and ordering an appraisal does not create any of those relationships. Any settlement figure we reference reflects our independent opinion of value and is not a guarantee of what your carrier will pay.
Fees and refunds
Our appraisal fee is earned when we begin work and is nonrefundable. This applies to first party claims and to any report prepared on an as is basis.
Limitation of liability
Our reports reflect our professional opinion of value. We do not guarantee any particular outcome, and we do not guarantee that our valuation will exceed the insurer’s. To the fullest extent permitted by law, our total liability arising from our services is limited to the amount you paid us for the report at issue, and we are not liable for indirect, incidental, or consequential damages. Nothing here limits any liability that cannot be limited under applicable law.
Attorney referrals
On occasion we may suggest escalating your claim and may provide the name and contact information of an attorney who could help. It is your responsibility to contact that attorney, and any dealings with that attorney are between you and them, private and outside our involvement. We do not collect referral fees. An attorney we refer may use the appraisal you already paid for to help move your claim forward.
Complaints and reviews
We value your feedback. If you have any concern about our service, please contact us directly so we have the chance to make it right. You can reach our corporate attorney, Mark Calhoun, Esq., at 770-409-1529. We welcome honest reviews and want the opportunity to resolve any issue before or after you share your experience.
Total loss appraisal general guidelines
- Vehicles must be valued at $3,000 or more.
- We need a copy of the insurer’s vehicle valuation report.
- We normally do not inspect the vehicle, so we will not dispute the condition stated in the insurer’s report.
- There is no guarantee our valuation will be greater than the insurer’s.
- Our comparable vehicles are as of the date of the appraisal, not the date of loss.
- If the insurer requires a physical inspection, do not order a desk appraisal.
- Our appraisal fee is nonrefundable.
